onCharge provides an electric vehicle (EV) charging platform that connects drivers with charging stations. Our Services allow you to:

  • Locate available EV charging stations via an interactive map
  • Scan QR codes to initiate charging sessions
  • Pay for charging services using integrated payment methods
  • Track charging session history and energy consumption
  • Manage payment methods and billing information

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Possess a valid payment method
  • Provide accurate and complete registration information
  • Comply with all applicable laws and regulations

4. Account Registration

4.1 Account Creation

You must create an account to access our Services. During registration, you will provide:

  • Your full name
  • Phone number
  • Password
  • Payment information

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account

5.2 Prohibited Conduct

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Services
  • Use the Services for fraudulent purposes
  • Reverse engineer, decompile, or disassemble the app
  • Share your account credentials with others
  • Use automated systems (bots) to access the Services
  • Abuse or damage charging station equipment
  • Bypass payment systems or charging fees

5.3 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes.

6. Charging Services

6.1 Station Availability

While we strive to provide accurate real-time information, we do not guarantee:

  • Charging station availability
  • Station operational status
  • Charging speed or power output
  • Compatibility with all vehicle models

6.2 QR Code Scanning

To start a charging session:

  1. Locate a charging station on the map
  2. Scan the QR code at the station using the app
  3. Connect your vehicle to the charger
  4. Confirm the session start in the app

6.3 Session Monitoring

You can monitor your charging session in real-time through the app, including:

  • Energy consumed (kWh)
  • Session duration
  • Estimated cost
  • Battery charging status

6.4 Session Termination

You can stop a charging session at any time through the app. Charges will be calculated based on:

  • Energy consumed
  • Session duration
  • Station-specific pricing

7. Pricing and Payments

7.1 Pricing

Charging fees vary by:

  • Charging station operator
  • Location
  • Time of day
  • Energy consumed (kWh)
  • Session duration

All prices are displayed in Indian Rupees (INR) and include applicable taxes.

7.2 Payment Methods

We accept the following payment methods:

  • Credit/debit cards (Visa, Mastercard, RuPay)
  • UPI (Unified Payments Interface)
  • Digital wallets (as available)

7.3 Payment Authorization

By adding a payment method, you authorize us to charge:

  • Charging session fees
  • Applicable taxes
  • Service fees (if any)
  • Penalties for equipment damage or misuse

7.4 Payment Processing

Payments are processed through secure third-party payment processors (Stripe, UPI providers). We do not store complete credit card numbers.

7.5 Pre-Authorization

We may pre-authorize your payment method before starting a session to ensure sufficient funds are available.

7.6 Billing and Invoices

You will receive:

  • Session receipts via email/app notification
  • Detailed transaction history in the app
  • Monthly billing statements (if applicable)

7.7 Failed Payments

If a payment fails:

  • You will be notified immediately
  • Your account may be suspended until payment is resolved
  • You may be charged late fees or penalties
  • We may pursue legal remedies to recover owed amounts

7.8 Refunds

Refunds may be issued for:

  • Overcharges due to system errors
  • Failed charging sessions where no energy was delivered
  • Duplicate charges

8. Location Data and Permissions

8.1 Location Services

Our app requires location permissions to:

  • Display nearby charging stations
  • Enable navigation to stations
  • Verify your presence at a station for QR code scanning

8.2 Permission Management

You can manage location permissions in your device settings. Disabling location services may limit app functionality.

9. Intellectual Property

9.1 Our Rights

All content, features, and functionality of the Services, including but not limited to:

  • Text, graphics, logos, and images
  • Software code and algorithms
  • Trademarks and service marks (“onCharge” brand)
  • Map data and station information

are owned by onCharge or our licensors and are protected by copyright, trademark, and other intellectual property laws.

9.2 User License

You are granted a limited license to use the Services. You may not:

  • Copy, modify, or distribute our content
  • Use our trademarks without permission
  • Create derivative works

10. Third-Party Services

10.1 Charging Station Operators

Charging stations are operated by third-party partners. We are not responsible for:

  • Station maintenance or downtime
  • Equipment malfunctions
  • Safety incidents at stations
  • Disputes with station operators

10.2 Payment Processors

We use third-party payment processors (Stripe, UPI providers). Their terms and policies also apply to your transactions.

10.3 Map Services

Map data is provided by third-party services. We are not liable for inaccuracies in navigation or location data.

11. Disclaimers and Limitations of Liability

11.1 Service “As Is”

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONCHARGE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from use or inability to use the Services
  • Third-party actions or equipment failures
  • Vehicle damage (except due to our gross negligence)

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE PAST 6 MONTHS OR $5,000, WHICHEVER IS LESS.

11.3 Indemnification

You agree to indemnify and hold harmless onCharge, its affiliates, officers, employees, and partners from any claims, damages, or expenses arising from:

  • Your use of the Services
  • Violation of these Terms
  • Infringement of third-party rights
  • Your negligence or willful misconduct

12. User Conduct and Responsibilities

12.1 Proper Use of Equipment

You agree to:

  • Use charging equipment as intended
  • Follow all safety instructions
  • Report damaged or malfunctioning equipment
  • Not tamper with or damage charging stations

12.2 Vehicle Compatibility

You are responsible for ensuring your vehicle is compatible with the charging station before initiating a session.

12.3 Parking and Access

You agree to:

  • Park only in designated EV charging spaces
  • Vacate the space promptly after charging
  • Comply with station-specific rules and time limits
  • Not block access to charging equipment

13. Suspension and Termination

13.1 Our Rights

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • Your account is used fraudulently
  • You damage charging equipment
  • Payment obligations are not met
  • Required by law

13.2 Your Rights

You may close your account at any time by:

17.4 Assignment

You may not assign or transfer these Terms. We may assign our rights without restriction.

17.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, power outages, or network failures.

These Terms are provided in English. If translated, the English version shall prevail in case of conflict.
